[GIURIDICA - MANOSCRITTO] - Commentario al codice. Padua: ca.1487.   An interesting legal manuscript from the second half of the 14th century, a commentary on the Justinian code by a law student at the University of Padua, according to the lesson of Giasone del Maino (1435-1519).   The text opens with a speech read at the law school of Padua by Giovanni Zaccaria Campeggi (1448-1511) who from 1483 began teaching at the university where he remained until 1503 occupying the chair of civil law (2 leaves). Two prayers follow, one is ""Ad Pasqualem Maripetrum illustrissimum Venetum ducem oratio congratulatoria, versio electronica"" by Mihetic, Ambroz (c. 1420-1487), dated 1458 and repeated twice, an initial fragment (1 leaf) and then the complete text (3 leaves) and the Oratio gratulatoria pro civitate Veronae ad Pasqualem Maripetrum, ducem Venetiarum, Di Lelio Giusto. Several copies of both exist and are dedicated to Doge Pasquale Malipiero (1392-1462) who also held the office of mayor of Padua; probably they were copied here as examples of oratory art and with a celebratory purpose. Then the main section starts, the commentary of the codex, which we know was written between May 5th (Incipit die quinto mense maii 1487) and September 11th 1487 under the direction of Professor Giasone del Maino important commentator of the ""mos italicus school"" (Scripsi in scholis domini Giasone del Maino inscripsi sub anno domini 1487 die 11 Septembris ego Joannes M (?) De Moresellis). The topics covered are the following: De iuris & facti ignorantia (13 leaves); De precibus imperatoris offerendis (8 leaves); Si contra ius vel utilitatem publicam (6 leaves); De diversis rescrip (3 leaves); De procuratoribus (25); Ne liceat potentior (3); De iudiciis (49); De inofficioso testament (36). The final leaves (7) are dedicated to the discussion on the theme ""Victus victori"" (the reimbursement of expenses is up to the winner) and other issues related to the remuneration of lawyers.   The manuscript is an important testimony of the study of law in Renaissance Italy that has survived in its original form.   Folio (330 x 230mm). 161 leaves of manuscript on paper, italics of mercantile derivation, paper with libra watermark within globe surmounted by two pallanti? and a cross (some tears with occasional text loss, some sporadic stains and worming). Contemporary wooden boards backed in leather (worming on covers, lacking clasp, some loss to spine).   For this lot, the notification procedure for particular cultural interest was initiated by the Italian Soprintendenza on 19 September 2022. Therefore the lot must remain on Italian territory and cannot be exported.
